1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Brasswind" / "we" / "us" / "our" — refers to Brasswind, the watch repair workshop operating at 88-1, Jalan SS21/37, Damansara Utama, 47400 Petaling Jaya, Selangor, Malaysia.
- "Client" / "you" / "your" — refers to the individual who engages Brasswind for a service, submits an enquiry, or uses the website.
- "Service" — refers to any watch repair, servicing, or restoration work carried out by Brasswind, including the Care & Comfort Service, Mechanical Service & Regulation, and Heritage Restoration.
- "Website" — refers to the Brasswind website at https://brasswi.cyou.
- "Agreement" — refers to the contract formed between Brasswind and the Client when a Service is accepted and confirmed.
2. Acceptance of Terms
By using this website or by requesting or receiving a Service from Brasswind, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the website or request services.
You confirm that you are aged 18 or over and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person (for example, submitting a watch that belongs to a family member), you warrant that you are authorised to do so.
We reserve the right to update these Terms from time to time. Updated terms will be posted on this page with a revised date. Continued use of our services after any changes constitutes acceptance of the revised terms.
3. Services Provided
Brasswind offers three watch care and repair services from our workshop in Damansara Utama, Petaling Jaya:
- Care & Comfort Service (RM 480): Battery renewal, seal and gasket inspection, case and bracelet cleaning, and fit adjustment for quartz timepieces.
- Mechanical Service & Regulation (RM 1,980): Full movement disassembly, cleaning, lubrication, timing regulation, and written condition report for automatic and hand-wound movements.
- Heritage Restoration (from RM 4,300): Individually scoped restoration service for vintage or sentimental timepieces, including case refinishing, dial assessment, and period-correct part sourcing where applicable.
All services are performed at our Petaling Jaya workshop and are available to clients from throughout Malaysia who are able to visit in person or arrange delivery. We do not currently offer postal watch service.
4. Service Process and Client Obligations
The following process applies to all services:
- An assessment of the watch will be conducted before any work begins. A quote will be provided and work will not proceed without the client's explicit confirmation.
- The client must have legal ownership of the watch or written authorisation from the owner to bring it in for service.
- The client must disclose any known damage, modifications, or previous repairs to the watch at intake.
- If additional work or costs arise during the service, Brasswind will contact the client for confirmation before proceeding.
- Watches left uncollected for more than 60 days after completion notice will be stored at the client's risk, and storage fees may apply after 30 days.
5. Payment Terms
All prices are stated in Malaysian Ringgit (RM) and include applicable taxes. Payment is due on collection of the watch, unless otherwise agreed in writing.
For Heritage Restoration projects, a deposit of up to 30% may be requested before work begins, particularly where specialist parts must be sourced. This will be confirmed in writing before any deposit is requested.
Brasswind reserves the right to retain a watch until full payment is received. If payment is not received within 14 days of collection notification, we reserve the right to charge a reasonable storage fee and, after 90 days, to treat the watch as abandoned in accordance with applicable Malaysian law.
6. Cancellation and Changes
You may withdraw your watch from service at any time before work has commenced at no charge. If work has already begun, you will be charged for work completed up to the point of withdrawal at a pro-rata rate.
For Heritage Restoration projects where specialist parts have already been ordered, the cost of those parts and any non-refundable supplier charges may be passed on to the client in the event of cancellation.
7. Intellectual Property
All content on the Brasswind website — including text, images, layout, and design — is the property of Brasswind or is used with permission. You may not reproduce, distribute, or use any part of the website without our written permission.
Service documentation issued to clients (condition reports, restoration records) is provided for the client's personal use and to accompany the watch. It may not be altered, reproduced commercially, or misrepresented.
8. Limitation of Liability
Brasswind takes all reasonable care when handling watches and performing services. However, we accept no liability for:
- Pre-existing faults, damage, or fragility not disclosed or identifiable at intake
- Damage arising from the natural age or condition of a vintage piece where the risk was disclosed
- Inability to source specific parts for older movements
- Loss of use or any indirect, consequential, or economic losses
Our total liability to any client in connection with a service shall not exceed the amount paid for that service. Nothing in these terms limits liability for fraud, wilful misconduct, or as otherwise prohibited by applicable Malaysian law.
9. Disclaimers
While we aim to return every watch in good working order, we cannot offer specific performance outcomes as a condition of service. Watchmaking involves inherent variability, particularly in older or previously damaged movements.
The website is provided "as is". We make no warranties regarding accuracy, completeness, or uninterrupted availability of the website or its content.
10. Dispute Resolution and Governing Law
In the event of any dispute, we encourage clients to contact us in the first instance so we can seek to resolve matters directly. Please write to [email protected] with the details of your concern.
These Terms and Conditions are governed by the laws of Malaysia. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Clients in Malaysia also have rights under the Consumer Protection Act 1999 that are not affected by these terms.
11. General Provisions
- Entire agreement: These Terms, together with any written service quotation or confirmation, constitute the entire agreement between you and Brasswind.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that right.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
